What is the difference between registration and residence registration in Ukraine?
Registration place is this?
According to the legislation of Ukraine, this term means a physical address where a citizen of the country, a foreigner or a stateless person permanently or predominantly resides. A person can live in his own apartment, or under a lease agreement, sublease.
Registration at the place of residence is all rather arbitrary, and in real life a person does not often encounter situations that it affects. But the stamp in the passport must be mandatory! If a citizen or foreigner has an ID card, then such an individual must have an extract with a corresponding mark.
In what cases of interaction with government agencies it is necessary to have a mark with the place of registration in the passport, ID card:
- When registering a vehicle. For example, if a person is registered in the Lviv region, but lives and bought a car in Kyiv, then all the same, he will be given Lviv license plates;
- During treatment in public hospitals, hospitals. For example, if a citizen came from Lviv to Kyiv and wants to go to the hospital here, then he will have to issue a referral from a Lviv doctor to a Kyiv clinic (does not apply to private medicine);
- The military registration and enlistment office conducts conscription only at the place of registration. For example, if a teenager studies in Kyiv, and is registered in the same Lviv, the conscript’s summons will be sent to him at the Lviv address. To resolve this issue, you will have to go to Lviv;
- When re-pasting a photo in a passport or receiving a new identity document;
- When a child enrolls in a kindergarten, school or lyceum;
- When registering, re-issuing driver’s documents;
- Foreigners apply for a temporary, permanent residence permit only at the place of registration.
In what cases of interaction with officials, the stamp in the passport with a specific location does not matter:
- When opening a company (LLC). Here you need a legal address;
- When opening an individual entrepreneur;
- Upon admission to a higher educational institution;
- When registering a purchase, sale of property;
- When applying for a job in a private or government organization.
Simply put, for the government of Ukraine, the place of registration is of great importance. For a private business, it doesn’t matter at all!
What is temporary residence registration?
This term is rather arbitrary and existed only in the days of the USSR, when there were seasonal jobs, shifts, long business trips, when handymen and highly qualified specialists were sent to uninhabited regions of the country to implement large infrastructure projects. In the latter cases, temporary registration or, in a modern way, registration was invented in order to know where to look for a particular specialist.
It worked according to the following scheme:
- A worker came to the desired region and rented a house, most often rented a room;
- The owner, who is also the landlord, was obliged to record the new tenant in his own house book, which was periodically checked by the local policeman;
- The tenant of the room came to the passport officer, she put a stamp in the documents and wrote on it with a pen the date of the end of the temporary registration;
- After the end of seasonal work, the person again came to the passport officer, she put a new stamp that the person was discharged;
- After returning home, the worker had to go to the local police station and report his return, which could be noted on the identity documents.
Since 2014, when the conflict began in the Donbas for IDPs in our country, they returned this term and began to put stamps with the place of residence in the corresponding certificate. In the database of the migration service, such people are recorded so that they are registered in Donetsk, Luhansk, but temporarily stay in Kyiv, Lvov, Odessa or another city in our country.
Here the question arises: “What is the difference between the place of residence and the place of actual residence”? And the difference between these concepts lies only in the fact that a citizen is registered and is most likely the owner of an apartment at one address, but at the moment is located in another city. For example, in earnings or those very seasonal jobs. But you do not need to go to the center for the provision of administrative services and indicate your temporary place of stay if the person is not on a suspended sentence. In the latter case, he needs to report to his inspector at the local police station and inform him that he will live and work in another city for some time and that he will be registered with the inspector of the area to which he is leaving.
There is also an option when a citizen or a foreigner has temporarily moved to live and work in another region and decided to register his place of residence there. In this case, he negotiates with the owner of the house, who rents the need for such a service. Then the landlord, with all his title documents, goes with the tenant to the local migration service office and draws up the last residence permit. But even in this case, the mark with the registration end date is not put!
How is registration and registration in Ukraine formalized?
In order to understand this issue, it is worth remembering how it happened in the recent past. Firstly, a citizen, a foreigner with a temporary or permanent residence permit, had to go to the passport office at the Ministry of Internal Affairs at the place of valid registration or registration (in a new way) and stand in line to check out, which was stamped in the identity document visitor. Secondly, a person must personally come to another passport office, at the place of his new residence, where, after submitting all the necessary documents, he was registered (registered) at a new residence address. As a confirmation, he was again stamped in his passport with a new address. The same procedure was required to go through the military commissariat, where similar marks were put on the military ID. In some cases, they also wrote in the passport that a man of military age is registered with a military registration and enlistment office, for example, in the city of Kyiv. And do not forget that every happy owner of real estate had a house book, in which everyone who lived in certain square meters had to write down. The local police officer could come and check this book at any time. If the data in the passport office and the house book did not match, then they issued a warning demanding to make changes about the residents, and in some cases they could write out a fine.
The same procedure goes like this today:
- A citizen, a foreigner, comes to the center for the provision of administrative services at the place of his new residence with an ID card and documents of ownership of the apartment in which he lives;
- An ASC employee on the spot notes in the database of the Migration Service of Ukraine deregistration at the old address and registration in a new city, district or house;
- The next day, the person returns to the same ASC, and he is given an extract with an official seal, with new information about the region of residence.
If a citizen wants to register in a house that he rents, then in addition to all the above, he will have to provide the official with the notarial consent of the owner of the property. And do not forget that for men no older than sixty years old, it is still necessary to go through the same procedure in the military registration and enlistment office, but without documents of ownership of real estate for the house and without the participation of the owner of the living space.
Where do you register at the place of stay?
Until recently, this procedure was carried out at the passport office, moreover, reception days were only on Tuesday and Saturday. Now, registration is issued at the center for the provision of administrative services. As a rule, such centers are located on the first floors of district or city state administrations, in a village, this is a village council. In Kyiv and other large cities of Ukraine, there are even separate institutions, called: “Passport Service” and “Ready”.
How is registration at the place of stay in such institutions:
- A person pre-enrolls in an electronic queue without leaving home;
- At the appointed time comes to the specialist with all the relevant documents (passport or ID card with an extract, identification code, real estate purchase agreement, apartment rental agreement, if necessary);
- If the papers are in order, the citizen or foreigner is removed from registration at the previous place of residence and registered at the new one.
For information! ASC also provides a number of other services, opening, liquidating of a company, issuing, replacing a passport, temporary, permanent residence permit, issuing an electronic signature key, and so on.
Important! If you applied to a law firm for the service of registering a place of residence or found such a service for advertising on the Internet, you need to remember how to negotiate with such people who want to make a profit from you. Everything is very simple here! If you are scheduled to meet directly in the building of the ASC, there you go together to the inspector who will take you through the database of the migration service and issue an extract immediately or on the second day, then everything is fine. If you are told to come to some office, leave your documents and take them away in a few days, then it is not recommended cooperating with such people. Before you go to a meeting, ask the seller for the address where you will be registered and see if there is any information about him on Google. If there is a lot of negative feedback, then ask for a different address. Also, always ask about the postal service, especially for non-residents. If a letter comes from the migration service, and it is returned to the sender, then in the future there may be problems with the extension of documents or obtaining citizenship. There were cases when people were even deported due to their actual absence from their place of stay.
Difference between registration and registration?
When at the beginning of the twentieth century on the territory of the Soviet Union, of which it was a part, and Ukraine, the first population census was carried out, it was decided to issue passports to most of the population. First, this concerned urban residents, in the villages people were not given any documents due to the lack of the right to leave their native collective farm. The Ministry of Internal Affairs decided to create a card index for every citizen of the country. A corresponding department was created, where a card with a photo, passport data and place of residence was introduced for each city dweller. Also, an address bureau was created in the structure of the Ministry of Internal Affairs. The data on the place of residence was taken very seriously, this is due to the fact that in cases of which the person could be easily found. They began to put stamps in the passports of the established form, on which they wrote by hand where this or that person lived. This was called registration, without which the document was not valid. But this procedure was relatively simple. A person came to the police station, told where he lived and was stamped with him. When moving to another city or region, the procedure took longer and a little more complicated. When Ukraine seceded from the USSR and declared independence, this situation persisted until the beginning of the 2000s. The district police officer went to the houses of his district and checked whether the person really lived in the declared place, got acquainted, questioned the neighbors, what kind of person he was and wrote characteristics that were attached to the case. Also, the operating commission of housing for the population participated in this scheme, which also needed to be informed where you live. Simply put, registration is a whole system of control over a person, as it was believed, to forestall crimes. In 2002, the registration was canceled and registration of the place of residence was introduced. This greatly simplified the procedure. For a citizen, a foreigner who has a temporary or permanent residence permit in Ukraine, it is enough to visit the passport office, and now the center for the provision of administrative services with the relevant documents and, depending on the workload of the inspector, he will change the data on the place of residence in the passport or ID card within one hour. Now a person is not obliged to go to the police station, housing maintenance commission, and so on. The only moment, if a citizen is liable for military service, he will have to notify the military commissariat about the change of registration address.
